The Cat Killer Ordinance or Animal Abandonment Ordinance will be discussed by the Modesto Safety and Communities Committee of the Modesto City Council on Monday February 4, 2013 at 5:00 PM, in room 2005 at 1010 10th Street. We have

to thank Interim Police Chief Gene Balentine, Captain Harris,  Councilmen Muratore, Geer, and Gunderson along with City Attorney Susanna Acala Wood and Mayor Marsh for pushing this ordinance through so quickly.The Committee consisting of Councilmen Lopez, Geer, and Gunderson will have to vote on it and if approved, send it on to the City Council.

D.A. Birgit Fladager needs to step up to the plate for past infractions committed by the two men and can be encouraged by the public to do so and enforce existing State Law against animal abusers at 525-5550.

Mayor, Council, LAFCO Just Cost Modesto MILLIONS

At last night’s Local Agency Formation Commission or LAFCO a vote was taken to give special interests a leg up on the competition and the citizens of Modesto are footing the bill.  LAFCO Commissioners voted to repeal a 2010 Resolution, #2013-01 which states if an out of boundary service extension, which in this case is a sewer extension to the Beard Trust Industrial Park, is allowed the future purchasers of the property are required to sign a waiver not to oppose their annexation by Modesto.

It seems like a small change but allows LAFCO Commissioners to be “swayed” by business owners in the future to allow for another exception to what is supposed to be the rule.  What difference does it make you ask?  Well check your utility bill next time you get ready to pay it and you’ll find a 6% utility tax/user fee added if you live in Modesto. Not only will Modestans be shorted this income but we lose out on the property tax collected every year.  The tax if you live in the county goes 100% to the county. If you live in an incorporated area (Modesto in this case) the split is 70/30.  70% to the county and 30% to Modesto. It doesn’t affect the amount of property tax a business has to pay.

But it does affect the amount of money Modesto has to hire more police officers.  All of our council members including the Mayor talk about finding more money to spend on police, but last night they insisted on giving it away. There is also a mill tax Modesto collects from businesses if they are in Modesto.

Lets all understand that businesses aren’t going to agree to be annexed into the city if they have a choice when they are already getting the services at no extra cost from the city.  Now our Mayor has claimed it’s easier to attract business if they aren’t required to sign a waiver.  But in his next breath he says the reason he wants to annex Salida is to make it easier to attract business.   Huh?  Why is it that in Beard Industrial Park it’s better NOT to be in Modesto and up around Salida it’s BETTER to be in Modesto?

Now if Beard Trust, which owns the industrial park, wants to make it more business friendly, why don’t they reduce the cost of using their private railroad which currently charges about three times the amount for each move of a rail car as do other railroads. Three times the cost to spot (bring it to your dock) the car and three times the cost to move it away.  This is what they’ve been doing since Tri-Valley came to town.  These excessive charges are at least one of the reasons Tri-Valley went under. Since they (Beard) own the land they refuse to allow any other railroad to service businesses there.

So why did the Mayor and the Modesto City Council actively participate in the fleecing of Modesto’s citizens by Beard Industrial?  I honestly don’t know.  It doesn’t make any sense especially since they keep crying about not having any money to pay for more police.  Don’t forget you’ve been paying extra to build and expand the water treatment plant and sewage facility.  They(the City Council and LAFCO) are giving away to their friends the bounty YOU paid for.

The vote was unanimous to grant Modesto and Beard Industrial their special private deal.  Despite pleas from the public to be our last bastion of defense against special interest politics, the Commissioners went along.  They actually said if the public didn’t like it they should go talk with their council members and not them. They want the power to make “special backroom” deals against the public’s best interests if and when the choose.  After all it isn’t breaking the law, if you change the law.  Unfortunately, in this case, they changed it for the worse.

In another decision they chose to break the Attorney General’s orders and allow Alternate Members of LAFCO to attend closed sessions.  The vote was three to two with Commissioners O’Brien and Bublak voting no.  So we could be facing an expensive lawsuit in the future.

The scary thing about this Board is they changed the official policy to give themselves more leeway in “special interest” decisions and when they couldn’t change the meeting law, they decided to break it.

You can’t watch these important meetings on-line because they aren’t video recorded.  You can’t watch it live since they don’t use streaming video. They do have an audio recording you can arrange to hear by appointment.  Last night we asked the LAFCO Board to consider televising, utilizing streaming video, and archive their meetings to allow those who can’t attend to watch their meetings.  They are now looking into the cost. We thank them for that.

You won’t read this in the Bee, at least not first hand coverage. Despite the potential millions of dollars being lost to Modesto, the Bee chose not to attend the meeting.  Then again maybe they had gotten a phone call and  knew the outcome was preordained.

If you live in Modesto you might want to take a moment to call your council representitive and ask why they gave away money that could have gone to pay for more police officers.

Former SCAP Director Appointment to Housing Committee Delayed but NOT Cancelled

On Tuesday the City Council came within moments of voting former Director of  SCAP Frank Ploof, onto Modesto’s Citizen Housing and Community Development Committee.  Mr. Ploof only served for two months as a Director on SCAP’s Board according to Julie Hannon.  Our concern is the ongoing relationship that developed between Daryl Fair, who was the President of the SCAP Board during the worst of the excesses, and who recruited Ploof for SCAP and  the Renaissance Center.  They continued to have an incestuous relationship with SCAP and the organization they billed as a nonprofit, the Renaissance Center.  Fair was the Executive Director and Ploof was a “case manager” and SCAP was paying the rent for the building on “D” street where the pseudo nonprofit was located.

Incredible as it sounds the Finance Committee met according to Julie Hannon, in November to interview eight candidates and choose Ploof. Interesting, since the City website shows the November and December meetings of the Finance Committee being cancelled.  Ms. Hannon told us Councilwoman Stephanie Burnside and Councilman David Cogdill Jr. were the ones interviewing the candidates.

While Mr. Ploof seems like a nice enough man, his relationship with Daryl Fair is a cause of major concern when it comes to Modesto’s Housing Committee.  And we have to wonder about the reasons J. David Wright is buzzing like a bee from councilperson to councilperson promoting Mr. Fair and his search for money to open a homeless drop in center.  It should also be noted J. David Wright was one of Modesto’s larger contributors to local Council races.  Why is Mr. Wright involved with people fronting for phony nonprofits?

After sitting in with the Finance Committee interviewing candidates for the planning Commission and the Board of Zoning adjustment and hearing the probing questioning, I’m surprised Ploof slipped through.  Though in all fairness it should be pointed out Ploof omitted disclosing the SCAP position from his questionnaire. And since City Manager Greg Nyhoff failed to document his investigation, or lack there of,  into the SCAP debacle, the Council members would have to be paying attention to the media to have known. Councilman Lopez asked for this appointment to be delayed and the rest of the council agreed and it was sent back to committee.

We have no doubt with seven others to choose from the Committee can find another capable candidate.

Mayor Marsh Wants Salida Ad Hock Committee to Meet Without the Public Being Present

The Mayor finally admitted having received the “Draft” of the Goodwin Study on the Salida annexation.  He had a meeting scheduled for this week and had staff relay to the public “Stay Home, you’re not invited.”  This is a major concern. Fortunately Supervisor Withrow had already given me an invitation.  When the Mayor was made aware of this he promptly cancelled the meeting.  Eventually it was rescheduled for Jan. 28,2013, but civilian member Thomas Reeves cancelled it, since the politicos were refusing to share the Goodwin report with the rest of the committee members.  I felt it was necessary and went to the Board of Supervisors and to the City Council to protest the Mayor’s actions.  Surprisingly the local print media failed to share this information with the citizens of Modesto or Salida.  Nothing like the third estate allowing games like these to be played. 

The bottom line is,  why the secrecy?

It’s only Money – OURS..!   $17,000 Extra for Soccer Fields

On December 4,2012, Item #16, with the consent of the council Staff pulled back the bids of the synthetic turf for the three soccer fields at Mary Grogen Park saying they had written the bid so poorly they only received a bid from one company which they said wasn’t competitive. On Tuesday they accepted a bid for $17,000 dollars more than the bid in December.  There were questions about the bidding process regarding the City not stating the way the bid was going to be judged. But this time staff didn’t care about the challenge made during the meeting, concerning the bid process, which was flawed or the fact it cost Modesto more money.  But what the heck it was only $17,000 out of Village One’s pocket-book right?    Huh?

Lower TIN CUP Limits Passes Committee and is Sent to Staff – Will Come Back in March

Something we’ve been trying to accomplish for several years is to lower the amount people can contribute to a candidate before  the now elected official has to step back or recuse themselves and not vote for an item brought forward by their contributor.  In Modesto this ordinance is called the TIN CUP or Time Is Now to Clean Up Politics.  The current amount is $3,000 dollars to all candidates and the new levels, if passed, will be $1,000 for council races and $2,000 for mayoral races.  Councilman David Geer and Councilman John Gunderson voted for the lowering of the limits and Councilman Dave Lopez voted against the proposal. Remember anyone one can continue to contribute any amount they choose but the candidate can’t vote for a proposal if the upper limit is passed.  This should help level the playing field for the average citizens. I hope people will call their council representatives and request they support the new levels. 

 After all,  does anyone think we need more money in politics?

Ridenour vs Marsh Two different ways of Treating Ad Hoc Committees

This is a follow-up to the Salida Ad Hoc Committee conversation.  Mayor Ridenour had two ad hoc committees while he was Mayor for eight years.  The City of Modesto’s Blue Ribbon Commission on Homelessness and the Comprehensive Fee Task Force.  Both were treated more or less as if they were regular City Committees, and for the most part, behaved as if they were subject to the Brown Act.  They announced the time and place of their meetings, had agendas, met in public, allowed the public to be present, and encouraged public participation albeit after we made a request to the Modesto City Council regarding the Blue Ribbon Commission.

Now the Salida Ad Hoc Committee is suddenly being treated differently than its predecessors. They don’t want the public to be present or the public to participate in the discussions. The only noticeable differences would seem to be the Mayors they were created under.  Just to be sure no other group was working on the people’s business and operating under the radar, we made a public records request. Here is their response. The only caveat in what you are about to read is that the Blue Ribbon Commission on Homelessness is still active despite having given their final report to the Council.

The last two Ad Hoc Committees formed were the Blue Ribbon Commission on Homelessness

and the Comprehensive Fee Task Force. I believe they have completed their work and made recommendations to the City Council.

 

The most recent Ad Hoc Committee formed by the City Council was the Salida Annexation Study Ad Hoc Committee

and they appointed Mayor Marsh, Councilmember Dave Cogdill, Jr. and a staff person.  

 

I am not aware of any other Ad Hoc Committees which have been recently appointed and are working on single focused issues.

Hopefully Mayor Marsh will come around and insist the Salida Ad Hoc Committee follow Mayor Ridenour’s example of being transparent when conducting the people’s business and adhere to the  requirements of the Brown Act.

Thursday 12/20 at 9:00 AM an animal abuse ordinance is going to be discussed which would allow cities to prosecute abusers, since our District Attorney, Birgit Fladager refuses to .  It’s a sad situation when cat killers like Phillip Sumner and Jeff Reed are allowed to lure, trap, and abandon animals without any penalties.

The meeting is going to be held at 3647 Cornucopia Way at the Stanislaus Animal Services Agency.  The Modesto City Council has taken the lead along with Chief Balentine and Captain Harris from the Modesto Police Department,  and we hope an ordinance will be in place by early February.  I know it won’t bring  justice to those suffering from past abuse, but hopefully it will help prevent future occurrences.

And if you can find time feel free to give our District Attorney Birgit Fladager a call and ask her why she won’t protect our pets.

Her phone number is 525-5550  I guess we shouldn’t be surprised no email is listed on the County’s website. Or if you are so inclined, appear at a Board of Supervisors meeting and tell them how you feel.

I went and spoke to them last night about this and other subjects during Public Comment Period.  They appreciate all of the input the public is willing to give them.  It’s towards the beginning of their meetings so you can speak and stay and listen or leave when you’re through.

They’re a friendly Board  and it really is almost painless.

Good morning.  I appreciate your taking the time to read this, and welcome your comments, both pro and con.

As you can see from the other attachment to my e-mail message, the City of Modesto has run deficit budgets over the most recent 7 years.  Actually, 6 years are known, and 2013 is only estimated.  But 2013 is seriously in deficit. 

There are several reasons for this, but the most easily identified factor is employee compensation.  A City job is worth at least 3.5 private sector jobs. City employee benefits are unconscionably higher than private sector benefits.  There is no reason a Modesto Citizen should be required to provide these enormous benefits, for which Employees pay virtually nothing.  Unfortunately, this situation is true for County, State and Federal employees.

The BEE repeatedly reports that City, County, MID and School employees have not received a raise in X years.  I need you to know that this is total nonsense.  Every one of those employees receives regularly scheduled “step and column” raises.  If you think I am wrong, look at the CAFR’s and see that, despite the lament that the number of employees is down, payroll is up, and it is significantly up.  The BEE recently reported that the median City Employee salary was $99,552 annually, not including overtime or bonus.  This is, as they say, unsustainable.

Despite this obvious fact, ALL our governments refuse to actually reduce salaries and benefits.  If you think this is an overstatement, just read the paper.  Every City union member has received multiple raises, and more are on the way.  Despite the fact that salaries and benefits are out of line, despite the fact that ALL of our governments are woefully underfunding pensions, despite the fact that they are ALL running deficit budgets, they continue to buy the union vote on the backs of the rest of us. 

All of us know that ALL our governments are too expensive; forget waste, fraud, corruption and stupid, payrolls are destroying every government and utility in America.  I am afraid that they are all going to fail, to one degree or another.

If we carry this discussion one step forward, I think we will agree that we are NOT spending too much money keeping our streets in perfect repair; we are NOT maintaining our City trees; we do NOT have clean, safe, needle and glass-free parks: we have NOT solved the plaque of homeless; our schools are NOT producing world-class graduates; our water, electricity, and sewer rates are NOT the lowest in the nation; and our crime rate is NOT reducing.  Friends, we have a problem, and it is NOW and it is LARGE. 

Let me make some guesses as to what will continue to happen if we do not solve this problem.

Your local and State taxes are going to rise like rockets.  Depending on your income and your wealth, the amount of extra taxes could be devastating.  Prop 30 will increase both your State income and sales tax.  Sales tax will be 7.625%.  Your income tax could increase between 21.5 and 29.13%, retroactive to 1/1/2012 .  Californians pay the highest State taxes in America.  And local governments will want even more.

Your Federal income tax could increase by as much as 14%, and most of us will see some increase.  Your Capital Gain tax might double, and your estate tax will increase by 500%. The maximum Estate and Gift tax bracket will become 60% on 1/1/2013!!  And the Feds will want even more.

Both medical care AND medical insurance costs are going to increase by large amounts every year for a decade.  It will be more and more difficult to obtain medical care from MD’s as nurses and technicians take over the majority of patient contacts.  Hospitals will close and their services will disappear from many communities.  “Discretionary procedures” like joint replacement, reconstruction cosmetic surgery will be severely rationed, medical appliances will become both rationed and expensive, and the elderly will not be well served.  Obamacare will be dominated by administrators paid enormous salaries.  And they will want even more.

Utility rates will continue to increase.  The MID debacle at the water plant will cost you dearly!  You are already paying for $187,905,000 of debt for a water plant that is half built.  You will pay at least another $50 Million or so to fix the junk MID calls “Phase 2”.  Consider the facts; divide the money spent by the annual output of this plant, and it comes to $6,264 per acre-foot just for the building.  Some may say that is an unfair way to calculate the cost.  Well, did you know that they have paid interest only on the last $93 Million they borrowed IN 2007!  AND, they are paying as much as 5.5% interest in a 1% interest environment. Your water and electricity rates will increase by at least 20% during the next 4 years.  And they will want even more.

Any product that contains or is transported by petroleum products or fuels will cost significantly more starting yesterday.  This includes virtually everything you eat, tires, many drugs, gasoline, diesel, and most of the clothing you use.  This includes the cost of airplane, bus, boat and train fuels and lubricants.  Heating your home will become very expensive.  The Feds will punish both the petroleum and coal industries with onerous taxation and costly regulation.  And they will want even more.

City debt, including the Redevelopment Agency debt is out of control.  We have upside down “interest rate swap” debt, and debt where we pay 16 years of interest with no payment toward principal.  The City has borrowed far too much.  And they will want even more.

Your property and Mello Roos tax, plus your fair share of school bonds will continue to go up.  School fiscal fiascos and mismanagement will continue to eat away your income.  These monuments to foolishness and greedy school administrators are a disgrace of waste and arrogance.  Despite the facts that enrollments are down over 12% in 4 years, some classes have 9 or fewer students, teacher and administrator pay is rocketing up, utility costs and maintenance costs are rocketing up, our elected school boards refuse to reduce teacher and administrator jobs.  They are actually proud that they have “saved jobs”.  Well, who PAYS for those unnecessary jobs???  Your Mello Roos tax increases every year.  And 71% of our Stanislaus State freshmen require remedial English, math or both.  School Boards have failed, your kids are cheated out of a quality education, and schools are out of money.  And they will want even more.

Finally, virtually every District, City, County, State and Federal entity will propose or actually impose new taxes and fees on you.  They will insist that they want to invigorate the economy, serve you better, and save jobs as well as the children.  You know that is all baloney.  The only jobs they want to save are their own, and they demand your money to do it.  The National Geographic magazine wrote a series on the fall of the Roman Empire.  A paraphrase of their conclusion would be, “The Roman government bled its Citizens white with taxes needed to support their vast, corrupt empire.”  And our greedy, ruthless and powerful governments will want even more, and more and more.

I believe the only solution to this insane fiscal situation is to starve these governments into submission.  Governmental spending is the problem, thus SPENDING must be controlled. The only way to bring employee costs into line is to force the unions to accept parity with the Citizens who pay their wages.  We must remove those elected officials who continue to stuff our hard earned money into the governmental black hole.  We must elect hard-nosed Citizens who will reduce the size of government and treat public money as sacred.  Smaller, less intrusive, less expensive, totally transparent and honest government is the only solution.  If you and I fail to achieve these goals, ALL of us will suffer and our governments will fail.

I try to bring a variety of concerns to the public’s attention and this topic has been brought to the attention of the Board of Supervisors (BoS)  and the Modesto City Council. 

Modesto resident Phillip Sumner says he has been capturing 18-20 cats each year for the last 10 years  here in Modesto.  Many, if not most of these were family pets.  An argument can be made they shouldn’t be in his back yard but he baits them by placing multiple cans of cat food in his yard to attract them.  He uses cages to capture them and then takes them miles away from his home and dumps them in city parks and business parks where, according to his own words “they’ll never find their way back here again”,  meaning home.  Maybe the worst part is he then brags to the families about his activities. He has even bragged to a family with a young autistic youth who “related” to his pet cat as a means of coping with the world, that he captured their pet and dumped it without remorse.

According to animal rights groups and local officials, most “pet cats” will starve when dumped in the wild unless adopted by people living around the parks.

 The Board of Supervisors paid little, if any, attention to the women who have had their pets captured and dumped around the city and the county, even after they made a heart-felt plea for help.  They have tried going to the District Attorney’s office but were told they were too busy to bother and also suggested the state animal cruelty and anti dumping ordinances weren’t applicable…basically they were told “go away and don’t bother us.”  I was actually told by a  member of the BoS  that in the scheme of things this wasn’t important enough for them to focus on.

These women appeared in front of the Modesto City Council to tell them of their problem on October 23,2012. This link will allow you watch and listen to the multiple women who spoke that night. Fortunately the City Council listened and cared.  First the women were referred to Police Chief Gene Balentine who listened to their story a second time, took notes and promised to get back with them.  One thing you can be sure about with Chief Balentine, if he says he’ll get back to you, he does.  After checking everything out he contacted the women again and told them of the situation. The D.A.’s office continued to rebuff the women’s concerns.  But the Chief came forward with an update when I spoke at the 11/13/12 Council meeting. I had spoken with Chief Balentine before the start of the meeting but since it had been three weeks I thought the topic should be brought up again during a Council meeting.  The Chief had spoken with the women several time and had laid the ground work for the next step. He and I had discussed this topic during the interim meeting where he brought me up to speed.  We had vocal support from Councilmen Joe Muratore and Dave Geer along with City Attorney Susanna Acala Wood who said once we have an ordinance we could be assured her department would aggressively pursue the offender.  City Manager Nyhoff spoke to help provide an update. 

Councilman Muratore asked me to assist in the search for an existing ordinances. I did do many internet searches and came up with four I thought would work best out of the many I sorted through.  I forwarded them to City Attorney Susanna Acala Wood for review.  Since then I’ve received the following email which was circulated to those who were following this with interest.

Sue/Sherry,

I just wanted to give you guys an update on what we’ve been doing.  Captain Mike Harris has been in contact with Annette Patton from the Animal Shelter, as well as representatives from the County and City.  Additionally I spoke with the County CEO’s office today (Doris) and she/they are interested in moving forward together.  What we are doing is researching other agencies with ordinances that would meet our needs.  The suggestion from the County District Attorney’s Office was that we consider adopting local ordinances that would be more on-point with this issue, rather than using the 597 section.  So, we are moving forward with that idea.  Captain Harris has located some ordinances and I believe the County folks also have some samples.  We plan to meet with the City and County legal staff to see if we can’t draft an ordinance that will meet the needs of the City and County, and can be adopted by each entity.  I believe they are meeting next week to try to hammer something out. 

 

Emerson, I know that you volunteered to assist in the project and also research some other city/county ordinances.  I’ve included Captain Harris’ email in the “cc” line of this email so that you can communicate with him any ordinances you may have located that you feel is on point.

 

Just wanted to update you on what is happening.  I’m hoping that once we get some good language in place the process can move fairly quickly.

So the system is working, the City Council, staff, and county personnel, along with citizens are working toward implementing the necessary City Ordinances to protect helpless animals.  And the wheels of justice are moving forward to stop the heinous practice of cruelly killing pets in Modesto by intentional abandonment.
