MID Staff and GM Allen Short Caught Lying to MID Board

We’ve spoken our concerns before regarding the accuracy and manipulation of information contained in staff reports, but seldom do they let you see  it so blatantly.  The report is titled Agreement for Directional Boring Contractors. It can be found in its entirety at the link at the bottom of the article.

To provide some very short background, when underground cable reaches its lifespan of approx. 25 years and the injection process they use to extend its usefulness’ warranty expires, it needs to be replaced. This is done by boring holes and replacing the cable.

Why Change Contractors?

MID has been using Applegate Johnson a local company with local employees satisfactorily for years.  There was a clause in their contract that allowed Applegate Johnson to request a rate hike. So they requested a hike and MID said no. MID was so upset, despite the fact MID had no other problems with this company other than their rate increase request, and instead of discussing their proposal, MID  sent the contract out for re-bidding to six vendors. Only five vendors responded and Daleo Inc of Gilroy was tentatively awarded the contract at the suggestion of nameless MID staff. The T & D Division and the Purchasing Department approved.  Assistant General Manager Tom Kimball and General Manager Allen Short both signed off as attesting to the truth of the presentation.

Here’s where it starts to get Hinky

On pages three and four of the report  are the actual bids the companies submitted.  Out of twenty-eight items Applegate Johnson was the low bidder on twenty-six and most of these by significant margins.  So why change vendors and was there a significant savings to be had by going with an out of the area vendor? According to the presentation given to the Board by Denise Ray of the Purchasing Dept and Asst. GM. Tom Kimball, Daleo was the most qualified bidder based on price,experience, and references.  But is that true?

Public Comment Period

It appeared the Board was going to vote for approval, but when the Public Comment Period opened a completely new story emerged.  Several speakers came and made their points regarding the contract.  At least two were from Applegate Johnson and pointed out Daleo’s  proposal was not only more expensive than their new one but was more expensive than if MID had used the numbers from the contract increase request they submitted.  Now company men speaking well of their business isn’t unusual, but something was different in this case. 

The Bid Numbers were Right in Front of  Us

Seldom are bids so clear and easy to read.  This one obviously was and while this was being discussed I went over them as did others. Twenty-six out of twenty-eight items  being in Applegate’s favor is easy to prove or disprove. It was easy to discern there was more than meets the eye going on  here. We’ve seen MID staff shuffle, concoct, and just create out of thin air some of the numbers GM Short has needed in the past whenever he’s challenged (see Reed Smith’s analysis of MID’s “extra” water to available for sale to the SFPUC).  I held up MID’s own documents and asked the Board members to look for themselves. I specifically addressed Directors Glen Wild and Paul Warda.  Mr. Wild,  known as a rubberstamp for GM Short and Van Groningen,  just looked bored as usual when “official reality” is challenged, but to his credit Director Paul Warda was intrigued by the opposing sides regarding the costs and wanted to get to the bottom of the dispute and requested more time to study the proposed contract.

MID Attorney Tim O’Laughlin Attempts to Obfuscate Details

All staff had to do was provide a breakdown that would support their claim of cost savings but O’Laughlin intervened and said he would prepare the rebuttal.  An important thing to understand is, if attorney O’Laughlin writes the staff report he covers it in what he considers his priestly robe of invisibility and will refuse to allow the public to see it (attorney client privilege).  But why would the attorney jump in so quickly?  The most probable reason is to prevent the public from finding out the reason for the strange and expensive to the ratepayers decision by staff.  Which in my opinion is either pique from the requested raise or blatant favoritism towards a bidder by steering the contract in a specific direction possibly for personal satisfaction or gain.

As ratepayers we can’t afford personal pique to enter into MID contract negotiations.  And anyone who does so should be summarily dismissed.  And since Tom Kimbal and Allen Short SIGNED this document saying the details are accurate and complete to the best of my knowledge, they should be held accountable for any misrepresentations.

Nothing happens at this level of MID without the General Manager’s approval. Nothing.

George Petrulakis Bills MID $28,852.50 for July More Ratepayer Money Down the Drain

The situation at the Modesto Irrigation District is getting worse by the day. More Brown Act violation.  More Public Information Act requests unanswered.  And now we’re paying a lawyer/ lobbyist/opinion maker another $28,852.50 in July to work against the ratepayers best interest.  We have expanded our request to include the invoices presented to MID by Mr. Petrulakis to discover exactly what he’s billing MID for.

Did MID Attny. Tim O’Laughlin Intentionally Mis-state the Truth? The Martino Contract and Payments

The meeting’s first skirmish centered around the Martino Graphics contract. This contract ran from July 19,2010, thru December 31, 2011, according to documents released by MID through a Public Information Request.  The response letter with the contract and amounts payable will be in the pdf at the bottom of the article.

When Director Byrd asked several questions about the contract, attorney Tim O’Laughlin claimed he wasn’t familiar with the dates or the amounts paid.  But as we have come to learn O’Laughlin reads and approves all Public Information requests (PIR) or Public Record Act requests (PRA) as they are known.  So O’Laughlin’s claim not to be familiar with the information is disingenuous at best. 

MID General Manager Allen Short made a similar claim of denying knowledge of any details of the contract despite having been copied, according to the information we were given.

When it was suggested the Board should receive copies of all PRI responses, Director Van Groningen said he and the rest had been copied.  So either they didn’t read the information or were stone-walling Director Byrd’s questions regarding the Martino Graphics contract.  The contract termination date 12/31/2011  is disconcerting since Martino Graphics has been paid by MID  $108,000.00 since February of 2012.

The reason this contract is attracting so much attention is this is the company GM Allen Short says they have been using to convey money to lobbyist and political opinion maker Mike Lynch.When I asked Marian Martino co-owner of Martino Graphics if she would discuss the contract she declined. Ms. Martino made a failed attempt to be appointed to the vacancy created by Kristin Olsen’s departure from Modesto’s City Council.  Interesting how these failed politicos come crawling out of the woodwork, isn’t it?

A PRI was made for the contracts and payouts including the dates for any and all lobbyists, opinion makers or any other titles or euphemisms MID chooses to confuse the ratepayers with.

The other action of note, was consent item #10 pertaining to the potential agreement with the International Brotherhood of Electrical Workers (IBEW) and the Confidential employees.  Director Larry Byrd decided to recuse himself on the IBEW since he has an adult son working for MID in the union and despite attorney O’Laughlin saying it wasn’t necessary.

The unusual thing was, despite Director Van Groningen thanking Mr. Batchelder’s hard work in achieving the agreement, the Board refused to bring forward a  vote to be considered.  Gamesmanship at its finest.  And yes a PIR was made to the Board to discover how much money was spent in this “staged” effort.

Is George Petrulakis a Paid Lobbyist / Lawyer for MID Here’s His Contract

We expressed concerns regarding any meetings between the City of Modesto and MID without Rollie Stevens being present especially when it was made known MID refused to allow Stevens to attend any meetings between them and Modesto City fathers.  When Modesto Mayor Garrad Marsh met with MID General Manager Allen Short with Attorney/Lobbyist George Petrulakis present we felt uncomfortable.  We were assured by the Mayor Petrulakis was just there as a facilitator. At the time, no one could prove Petrulakis was there for any other reason.  But now after you read the contract you’ll see he is being paid to influence Modesto’s elected officials to see things MID’s way.

You’ll be able to see how much Petrulakis is being paid by the hour and how much he’s received so far.

We’ll discuss MID’s choke hold on requested public information very soon, but for now read the contract and decide for yourself if this is the correct way to proceed.  If MID gets to have a paid attorney/lobbyist in the meetings shouldn’ t we?

Where is Assistant City Attorney Rollie Stevens?

While it doesn’t have the same connotations as asking “Who’s John Galt?” , “Where is Rollie Stevens?” should make people stop and think.  Rollie Stevens was Modesto’s  Attorney negotiating the water contract between the City of Modesto and the Modesto Irrigation District back in 2005.  This contract spells out the fact that Modesto and the Farmers stand first in line for OUR/MID water.  MID has demanded and Mayor Marsh has acquiesced to, Rollie Stevens absence at any talks between MID and Modesto.  Why?  Because MID knows Mr. Stevens is the most knowledgable  individual on the city staff regarding this contract which is vital to Modesto’s long-term BEST interests.

MID is supposed to be owned by the ratepayers but over the years, we ignored the MID Board and allowed the Board to spend/waste Millions of dollars unchecked, and at an ever-increasing rate.  In recent years the public exposed several of their ill-fated ventures.  One was the TANC project that the MID General Manager led, and despite public outcry against it, the proposal was curtailed only when (SMUD), Sacramento Municipal Utilities District came to their senses and pulled out of the monstrosity of overspending  that General Manager Short had helped to create. The cost to MID was approximately $5 million dollars.  The second was the Bio-Mass/ Garbage burner Project of Stephen Endsley.  After discovering how badly they were being duped by Endsley and MID, the MID ratepayers rebelled and finally MID pulled out of the garbage burner business.  The cost to ratepayers was $1.2 Million plus MID Attorney Tim O’Laughlin pocketed a cool $92,000.00 for this project alone.  This was despite being assured by attorney O’Laughlin that MID had no exposure to litigation. It seems it’s all a mater of perspective with O’Laughlin, who lives in Chico,  and doesn’t buy water or electricity from MID.

Now MID is pretending the small sale of 2,240 acre feet isn’t important, but as always the devil is in the details.  And the details here which bear importance are;  if the contract is signed, the San Francisco Public Utilities Commission will be first in line for any MID water for the next fifty years, yes before Modesto and the Farmers, and has first right of refusal over any potential water sales MID might care to make.  The contract also sets a price for future water sales which includes an extremely small price escalator.

Just as important and maybe even more so because of its size is the looming 25,000 acre foot sale.  MID intends on pursuing it immediately after the 2,240 sale, so both sales should be considered at the same time by ratepayers trying to make a decision.  We also need to consider the small sale doesn’t pay for anything. The 2,240 acre feet times the $700.00 per acre foot comes to $1,568,000. yearly.  At this rate it will take 70.79 tears to pay for the $110 Million in infrastructure the MID Board claims we need.  And yes, the much larger sale triggers an EIR or Environmental Impact Report but with the SFPUC  footing the cost and being the lead agency, stopping it at that point is a much harder task than most realize.

Now back to the initial question of  “Where is Rollie Stevens.”  To use a sports metaphor,  it’s like playing a Superbowl and having our coach decide to bench our all-pro quarterback or 2,000 yard running back because the other team doesn’t want to play against him.  Why would we concede to those conditions?

This is the $64,000 question we need to ask Mayor Marsh. 

So Mayor, why are you keeping Rollie Stevens on the sidelines? 

Modesto and the farmers need to stand shoulder to shoulder on the water sale issue.  Agriculture is the economic driving force in the Central Valley and we need to nurture it.  And as we all  know,  if you want to keep something alive in the Central Valley, you need to water it.

We have NO extra water for sale to San Francisco.

Rollie Stevens, we need you.

Also, here is a little teaser.  You know the MID has been using Martino Graphic Design INC to funnel money to political consultant and lobbyist  Mike Lynch.  But were you aware of the potential amount in their contract?  Under purchase order 54981 from July 23, 2010 thru December 31, 2011:

This contract is issued to provide professional services to Refocus and Enhance Public Education and Information per Board Resolution No. 2010-35.

Not-to-exceed $450,000.00 plus cost and expenses.

$450,000.00 for Lobbying?  Now you know why your rates are so high.  They been giving contracts like these to friends to stay in power.
