City Staff Says It Could Spend $2.5M – $6M but Says it Doesn’t Know Who Owns the Property

he City Council  might spend the ‘extra’ money from the 1% sales tax (Proposition X ) one funding option was for a annual/one time expenditure of $2.5 Million.  It was explained they  couldn’t decide which column, annual or one time, to place the funding option under but they could easily spend the money on infrastructure in the Bangs area.despite having already mentioned we needed to spend approximately $50 M for infrastructure to prepare the Kiernan East and South Business Parks.  But Brent Sinclair said he preferred to spend $6M in the Bangs area. He commented the land owners there were anxious to move forward.

I made a PRR to find out who owned the property Mr. Sinclair was in such a hurry to jump start.  Here was the response I received.

Apparently the Modesto City Council is in hurry to spend the money but claims they don’t know who will benefit from the voters largess should Prop X be approved.  More than just a little scary, or should I say disingenuous  don’t you think?

the City Manager Greg Nyhoff in the event the one percent sales tax doesn’t pass. The committee which consists of Chair-Stephanie Burnside. Vice-Chair David Cogdill, and Joe Muratore (absent with Dave Geer standing in) had made prior arrangements with Nyhoff and Mayor Marsh to withhold discussion because of Councilwoman Burnside’s unwillingness to voice her opinions due to  her up-coming re-election bid.  Of just as much concern was Nyhoff having not placed his recommendations on-line (they still are NOT on the city website.

All of the Department heads were there to discuss and or answer questions regarding the potential cuts but because of the previous behind the scenes agreement to help Burnside, no give and take took place.  As a matter of fact Nyhoff told the Dept. heads they could leave.  This article isn’t meant to be a discussion of the right or wrong of the sales tax or of the cuts, we’ll do that in another article.  It’s about disdain and the lack of  transparency by Modesto City officials towards the public. The room was full with Chamber of Commerce members,  a couple of members of the public and one candidate, Bill Zoslocki. Of potential interest were the only three people in attendance with color printouts in white folders, Brent Sinclair, lobbyist Cecil Russell, and candidate/developer Bill Zoslocki. Everyone else had the black and white copies from the table at the door.

Then there was the single page Nyhoff handed out during the meeting containing the cuts.  It was noted the potential deficit this year was $11.8 Million and much is expected to be the same next year.  If they don’t fill positions again this year in the Public Safety and Non-Safety Departments the deficit will be only about $8 Million.  Yet the goal for the day’s exercise was $6 Million.

This document outlines some of the development the City and County wants to implement under the General Plan Amendment project. The General Plan Amendment is the document that governs all of Stanislaus County. The Planning Commission will vote to approve it or not, on August 19th at their public meeting.

The redevelopment of our existing neighborhoods with be with low income affordable housing via the verbage on Page 11 of the agenda report entitled “Neighborhoods.”     This how our local government will destroy middle class neighborhoods, destroy thousands and hundreds of thousands of dollars in real estate gains, and destroy the social fabric of a group of similar families with similar values and behaviors.  By this document, our local government has decided to mandate that low income affordable housing will be incorporated into existing neighborhoods.  This is NOT a mandate by    state law, SB 375. This is OUR LOCAL GOVERNMENT’S planning ideas, and might I say, very bad planning without care for people’s current and future wealth that is present in the homes they own.  Let’s not even talk about the social problems that will occur from forcing low income or Section 8 (benefit) residents into our neighborhoods.  Low income housing needs to be developed and located properly within the city and county. The below new “neighborhood” redevelopment (per the General Plan Amendment document) is being mandated ACROSS THE ENTIRE CITY OF MODESTO (that’s incorporated and unincorporated areas). 

 

These kinds of housing plans are negligent misinterpretations and malformations of a “sustainable city” under SB 375 by local city planners and other government personnel who have written or approve the General Plan Amendment as it now states.  Anyone in our local government, or city planners, should respect people’s economic holdings of home ownership and the financial wealth that exists in the varying neighborhoods of this city. The expectation of real estate gains coming from the one major asset that families have, is sometimes, all that they have. There is no law that demands that low income housing should be incorporated into existing neighborhoods. The placement of low income housing is a very important decision and its location should not infringe or hurt any other existing resident’s real estate values. Low income housing brings various social and economic ills to middle class or upper class neighborhoods. It will destroy financial wealth for existing residents. These are real estate facts that are well known. This also intrudes into our constitutional protections to the pursuit of happiness and the foundation of economic prosperity that this country was built upon. Every American strives to reach higher, and as their lives progress and when they decide to invest in, they choose and spend thousands of dollars into a particular neighborhood because of its economic level, social behavioral expectations, and the type of residents who live there who have similar values. Homeowners who buy into middle and upper class neighborhoods have worked hard to afford it, and have finally achieved it, with no government handouts.

Local Modesto government and City Planners have no right to destroy the American economic model and cause financial injury to its residents who own property.

The below verbage of the General Plan Amendment document is a direct proximate cause of injury to residents if it passes.  The below verbage should be modified and deleted:

“The City of Modesto will promote and facilitate a fabric of complete, cohesive, pedestrian-friendly and family-oriented neighborhoods across the entire City. New neighborhoods are to be integrated with existing neighborhoods, through contextual design consideration, compact development patterns and application of Neighborhood Compatibility Guidelines and other applicable development guidelines.”

“Goal III.C
Neighborhoods. Neighborhoods should be complete, compact and sustainable so that housing, jobs, shopping and transit access are within easy walking distance of each other. Neighborhoods should include a mix of compatible land uses within close proximity, contain a diversity of housing types to accommodate a wide range of economic levels…”

“Policy III.C.1
Complete Neighborhoods. Complete neighborhoods promote livability, sustainability and safety for all residents. Modesto’s neighborhoods should contain: a mix of housing types including affordable and market-rate;…”

(“Compact” and “affordable” housing is referring to the city’s “sustainable city” high- density, low-income RHNA housing!)

Residents need to attend the Monday, August 19th Planning Commission public meeting and voice their opposition to this and other development under the General Plan Amendment document.
The Planning Commission meeting will be held at 6pm at 1010 10th Street, basement level.

Your voice is needed.   We all need to stand together, in as large of group as possible, to demand that this verbage be modified or deleted.  This neighborhood building code is just about millions of dollars in grant monies being paid to developers and having a steady stream of tax payer money paid to our government. SB 375 is just ONE method of reducing greenhouse gases by building compact high density cities. We need to encourage our government to use “other” ways to meet the 5% GHG reduction mandate by 2020.
We don’t have to let our government destroy our neighborhoods by low income housing (which people all over the Bay Area will come to live in it. There is no guarantee that our local residents will be chosen for it.).
Don’t think your voice won’t matter. There is only one more chance on August 19.

Unincorporated area residents of the City of Modesto need to be concerned about this too.

Modesto’s Future is Being Decided Will Your Voice be Heard? Modesto’s General Plan Amendment

On August 19 the Modesto Planning Commission will be meeting to formulate proposals to give to the Modesto City Council.

The discussion encompasses much more than just the Chamber of Commerce’s Pathway to SPRAWL.  It designates  areas inside the city where businesses will be allowed preferential treatment over homes, and Homes are already there.

The plan also designates the way they intend for people to live.  The transportation plan has a life of its own.  But rather than going on we think it’s more important for EVERYONE to look it over for themselves.  So here is the plan as it stands now with out including the Chamber of Commerce’s proposed changes.

Yours, Mine, Our futures are being plotted by this plan and to date very few of us have come out to the meeting to be heard.  No matter what your views are, if more people don’t show up to discuss the plan ALL of the suggestions made by average citizens (you and me, all of us) will be ignored.  The City Council does this regularly in order to support the SPECIAL INTEREST GROUPS (like the Modesto Chamber of Commerce) that have controlled Modesto for the past thirty years.

It’s important for everyone to participate in the ongoing conversation.  Please be part of helping to decided our future.  Read the proposal, think it through, and come out and speak your mind.   Thanks

July Salida MAC Meeting Now Available for Viewing

Thanks to Brad Johnson and 104.9 K-GIG FM  the Salida MAC  July meeting is available on line.  Watch land use attorney George Petrulakis, lobbyist Cecil Russell, real estate salesman Craig Lewis, Village I profiteer Bill Zoslocki, and conflicted LAFCO member Brad Hawn try to convince the audience that SPRAWL is a good thing and that concrete is better than Prime Farmland.  Now if we could only get the Chamber representatives to respect women….

Modesto Chamber of Commerce Representatives Get Offensive with Salida MAC Attendees

Despite the nice turnout of over 120 people the night had an ugly start when one of the Modesto Chamber of Commerce’s representatives, Craig Lewis, started making negative comments to a few of the people as they walked through the door.  (No, they weren’t directed at me)!  I believe he prefers to denigrate women as we heard several times as the night progressed.  I guess its the way he was raised, believing women belong at home, pregnant and if they want to have an opinion they should ask their husband for theirs, (heaven forbid they form an intelligent one of their own).

Unfortunately professionalism went right out of the window and the presentation continued going down hill from there.  Land use attorney, George Petrulakis, felt the need to call out several people in the audience during his part of the presentation, even before they had a chance to speak.  He made the mistake in attempting to suggest that a Del Rio resident, who in the past at a variety of meetings around the County, has been vocal in her attempt to save prime farmland,  had no real basis for her argument since she lived in Del Rio.  Several in the audience immediately stood up and requested Salida MAC Chairman Thomas Reeves to reign in  Mr. Petrulakis and insist he start using civility which he was obviously lacking.  George claimed he was only making a point, although at her expense.  Maybe in this case George should have stayed quiet since she stood up and pointed out he lived in Del Rio too and was attempting to convince others his opinion was the only correct one. Agriculture_Investment_Zones_Around_Modesto

It seems that according to Mr.Lewis and Mr. Petrulakis, the only people allowed an opinion are men since they were heard to  verbally abuse both females, an audience member and a member of the Salida MAC for having one.

During the meeting the Modesto Chamber’s CEO and head lobbyist Cecil Russell was overheard by several attendees to say “The problem with these people is they’re stupid, they aren’t smart enough to think outside of their small box.”  We freely admit this phrase was told to us by several people after the meeting.  And though their recollections varied slightly and the prior statement is paraphrased, we believe it is  extremely close to his original statement.

While the presentation was going on it appeared that several people who were first time attendees and lived in the Wood Colony area weren’t believing very much of what they heard.  Like most of us believe, the idea that the Chamber wanted to protect prime farmland by bringing it into Modesto’s General Plan was ludicrous. And when the Chamber reps started getting vicious and personal with the audience several couples  got up and left shaking their heads in disgust.

Very telling was hearing Cecil Russell trying to take the meeting over by attempting to not allow the comment time that Chairman Reeves had already scheduled immediately after the presentation for the listeners.  Now and in the past Cecil has refused to allow the general public to have a copy of his Pathway to Growth/SPRAWL plan and isn’t interested in any forum that allows debate.  He, and the Chamber, apparently intend on ramming it through the Modesto City Council where it’s believed he might already have the votes. The Modesto Council has ignored the public on every recent vote where preserving prime farmland is concerned.

Here is the most recent copy of the plan for greed and SPRAWL we’ve managed to obtain.  The is from the Modesto Planning Commission meeting July 15, 2013.  The Chamber refused to supply the Salida MAC with an electronic copy from their meeting.

The Chamber brought along most of their usual cadre of supporters, Brad Hawn, Dave Romano, Bill Zoslocki and a few others.  We found council candidate for District 4 Bill Zoslocki, a Village I profiteer, prefers to be called a “broker” rather than “developer.” From our view that like a highway man being offended by someone saying  he used a revolver  instead of an automatic during a hold-up, but if that’s what he prefers maybe he won’t jump up and melt down when his name hasn’t been used.  It seems like the Chamber’s buddies enjoy when members of the public are called out by name but take offense even when theirs isn’t used.  I have to think he recognized himself.

What the remaining listeners heard was the Chamber’s plan will bring 39 square miles into Modesto’s General Plan when Modesto proper is only 37 square miles. And the Chamber wonders why their plan is being called the Pathway to SPRAWL by those who see it for what it is. The largest bait and switch land grab in Modesto’s history.   After all, who could believe the Chamber was going to “protect” the farm study areas by bringing them into the General Plan?  From all of those I talked with there weren’t any believers that night.

And shame on the arrogance and lack of professionalism of the Modesto Chamber of Commerce for publicly going after these women by name.     Besides boys, these ladies will kick your butt at the ballot box!

A Salida Resident Talks about the Recent Salida MAC Meeting

I attended Tuesday nights Salida M.A.C. meeting and listened to the delivery and performance of Modesto Chamber’s
plan for expansion that will bring Jobs, Jobs, Jobs.  George does a pretty good job getting his point across. I did notice that a few items were left out of the delivery.  Namely that part about the property on Kiernan Road. I don’t know if that was intentional or not, but George does not make many mistakes.

There were a few disparaging comments made during the meeting as well that will probably hurt the Modesto Chambers cause.
Cecil Russell was overheard saying that the people of Salida are too stupid to see out of their own box”.  Hey, we don’t want to see anything but ALL OF SALIDA BEING INCORPORATED! You don’t see us stepping on Modesto’s toes as they can do whatever they want…..with Modesto!
Craig Lewis said he doesn’t think Amanda Sorenson dresses well for a meeting. Hmm, does she need wear clothes according to Craig’s dress code. WHAT? He also says that Katherine Borges is OPINIONATED!! OMG! Really? Thank God she has opinions and thank God we have a dedicated group of Salidan’s who care about the future of this town to donate their time and talents to make this a better town as well as contribute to incorporation. Yes, Katherine is opinionated…..and, I confess, so am I. Its beyond me to allow outside organizations, without expressing myself, to take over our town or chip away at our land as they did with Kaiser Hospital, Costco, Lowes and Save Mart.
 
We’ve said it before “STAY OUT OF OUR TOWN…EVERY SQUARE FOOT OF IT”! Take ALL of Salida OUT OF MODESTO’S PLAN AND SPHERE OF INFLUENCE!

Salida MAC Meets Tuesday Night at 7:00 PM At the Salida Library

Just a reminder to attend the Salida Municipal Advisory Council’s (Salida MAC) meeting tomorrow night (Tuesday) at 7 pm at the Salida Library Community Room. Featured topic will be “Pathways to Jobs & Prosperity” presentation presented by the Modesto Chamber of Commerce.  Their plan is an expansion upon the City of Modesto’s General Plan update and they’ve requested it be adopted by the Modesto City Council and Planning Commission.  Modesto’s General Plan has included Salida since the 1990’s.  A map of the plan can be viewed at the Salida MAC newsletter link below.
