Modesto Plans a General Amendment 2040 Update

Modesto is planning a public study session for Councilmembers and Commissioners, and is allowing the public to attend.  In a recent public records request, the city denied that Councilmembers had had any input into the General Plan Amendment. Unsurprisingly,  the City Attorney Adam Lindgren’s response was a point blank denial that ANYONE from the Council had sent any emails or texts to city staff regarding the GPA.  Do we believe that?  No!

I would suggest anyone interested in learning the city’s plans should try to attend or at least send a representative to be in the loop. The date is Monday, December 17, 2018, 6:PM Modesto Centre Plaza basement level.  The main entrance at 10th and K Street is recommended.

For Honesty, Integrity, Service, It’s Terry Withrow

When we’re evaluating candidates for local office many times it comes down to the lesser of two evils.  When it comes to the Stanislaus Board of Supervisors District 3 it’s an easy call because we have an extremely qualified candidate, Terry Withrow.   Sometimes candidates come to the position with preconceived notions.  Other times their notions/ideas have been pushed on them by special interest groups.  One of things that make Terry Withrow exceptional is he listens to his constituents.  I know that sounds easy but in this day and age that requires fundraising to get your message out, special interest groups (the Chamber of Commerce and developers) and those who collect politicians for money and personal power (George Petrulakis) will supply the money, but at a price.  Terry doesn’t take money from the deep pocketed developers.

 

When neighborhood residents come to Terry with concerns he hears them out and helps to find solutions.   He doesn’t pretend to have a magic wand (like his opponent does) and that all he has to do is wave it and everyone is instantly happy.  He understands how the County works and assists in not only explaining the correct path but he helps to get the ball rolling. And he doesn’t take his eyes off the ball, he stays focused through to the end.

 

He supported Modesto, Salida, and Wood Colony residents in their unified goal to preserve our way of life, our neighborhoods and our precious (some of the best in the World)  farmland.  When Salida became concerned about Cannabis shops being placed in Salida, Terry made sure their wishes were respected.

 

During the recent drought Terry was in the forefront in establishing and working with the Stanislaus County Water Advisory Committee bringing farmers, businesses and residents together to help resolve water issues and drought concerns going back to its formation in February 2014.

 

Terry has always remained open to people having questions or concerns.  Whether it’s during or after a Board meeting, a chance meeting in public or or public media, he is always willing to hear anyone’s ideas, problems, or concerns.  I’ve watched him give his cellphone number out to anyone who wanted to talk and especially to those trying to pick an argument.

 

When it comes to local politics it’s not the party that’s important.  Power brokers like George Petrulakis purchase Democrats, Republicans, or supposed Independents as often as they can.  Case in point…George even ran two candidates (one Republican and one Democrat)  against Terry  in the primary this year.

 

We’ve followed our political scene for many years and without a doubt Terry Withrow is one of the best people ever to be elected to office in Stanislaus County.   He deserves our continued support.  Vote for Terry Withrow for Stanislaus County Board of Supervisors District 3.

Creating the Perfect Storm, Developer Style

It’s getting close to that time again when we get to vote for the Stanislaus County Board of Supervisors.  But how do we separate the wheat from the chaff,  the good from the bad,  the place holders from the players.  We could do a breakdown of the political parties they represent. Or we could try to decide by their opinions on topics of importance.  But as most of us are aware, with a few of the candidates,  their opinions are like underwear that’s to say they get changed daily depending on the nature of their audience.

Unfortunately in local politics the latter is mostly true, unless, or maybe especially if their opinions are manufactured by those power brokers behind the scenes.  We have some that believe in paving paradise and putting up parking lots.  And some who don’t know what to believe and are just being used as pawns in a larger game.  Lets back up a few years for a moment and remember when Bill Zoslocki, Craig Lewis, Cecil Russell and yes George Petrulakis  were attending every meeting imaginable saying they needed to extend Modesto’s sphere of influence to the river on Modesto’s north and west sides.  That would have doubled the size of Modesto’s footprint.  And it was to be done in their words.. to protect our farmland.  And that of course was just a lie.

But many people stepped up to the plate among them were Terry Withrow and Jake Wenger, two of the higher profile politicians willing to take a stand against the Chamber’s Transportation Committee which at the time included Zoslocki, Lewis, Russell, and Petrulakis along with the then Mayor of Modesto, Garrad Marsh.  When the massive land grab was temporarily defeated, well at least a stand-off, the Chamber, led by Cecil Russell, George Petrulakis and others let it be know they were coming after Withrow and Wenger.  Let us not forget that soon after the upcoming election in June, Modesto will be taking another look at the General Plan Amendment that will put expansionism back in play again.  Refer  back to the article’s title.

A few short years later (last fall) George Petrulakis masterminded an ambush of Jake Wenger by Stu Gilman for MID  Director Division 4.  They used Janice Keating, the congregation of The House, a church in Modesto, a pocket full of money and a naive dilettante (or maybe I should say cunning) named  Katherine Borges to do their dirty work.  Keating probably made out the best since Gilman actually paid the political consulting  company she runs from her home, Fundamental,  $1,500.  Petrulakis is still owed $17,000 by Gilman for his expertise or was it actually a loan in disguise used for advertising?   Borges swallowed a completely improbable story, or at least did publicly, about Salida getting water from MID, which is contractually impossible, and let Gilman/Petrulakis use her endorsement (she eventually endorsed both candidates).  Now Borges is being encouraged by George Petrulakis (was this part of an earlier promise to get her to support Gilman?) and is running against Terry Withrow for Board of Supervisors District 3.   Could things get any curiouser?  Ahh, yes we can’t forget the chameleon  Tony Madrigal.

One interesting thing to know about George Petrulakis is that he’s an equal opportunity employer.  We learned out in Patterson when land use issues weren’t going his way he’d just as soon buy a Democrat as a Republican. In the past George swayed Modesto City Councilman Tony Madrigal several times… first he’s for saving Wood Colony from developers, then against, and now for again.  With Borges, he managed to find a reason that would allow her to support Gilman (imaginary available water) against Wenger. That along with playing to her desire for the attention.  So now he has two candidates running against Withrow.

In the other race Tom Berryhill a termed out retread who seems to be relying on name recognition, (after all it worked for Dick Monteith,)  Janice Keating who has lost her last two political races and was supported by George Petrulakis and Zagaris,  and Frank Damrell who has been an assistant for a Congressman working on Social Security issues.  Berryhill doesn’t even bother to campaign.  He expects people to remember his family name and vote for him.  He has no viable ideas just the desire for another paycheck from taxpayer’s money.  With Keating it’s pretty simple.  She took $28,000 from a MID slush fund and spoke publicly for the sale of our water to San Francisco.   Imagine if MID had had less water during the recent drought for both Modesto and the farmers to share all so a local businessman (can you say Bill Lyons) could make a windfall profit on selling water to the state.

Watching a recent Modesto Bee forum a few observations jumped out.  Tony Madrigal reminded us of Armando Arreola, a perennial Mayoral candidate in Modesto, who applies one of the three answers he has in his repertoire to every question he’s asked whether they address the question or not.  Katherine Borges the… I was a Democrat, then I turned Republican, now I’m pretending to be nonpartisan, now that even though I keep going to their meetings, the Republican Party chose not to back me… used former candidate for Supervisor Scott Calkins’  ideas from four years ago, which she loudly disdained then as she was actively campaigning for Withrow.   I know it’s hard to follow the changes ( remember the underwear analogy) but you can’t, and don’t have to,  make these things up.   Terry Withrow has stayed the course amid the stormy seas.  He defended Wood Colony and Salida from the aggressive aspirations of the Chamber of Commerce’s land grab developers.  He’s been a consistent voice for promoting our homeless issues despite the Modesto Mayor’s along with the Modesto’s business community’s (DoMo) foot dragging.  And he was one of the prominent voices on County water issues during the drought. The fact that land use attorney George Petrulakis has two candidates in the District 3 race, Madrigal and Borges, brings super clarity to the issue. Terry Withrow is the only real choice if we want insure the public has an independent voice on the Board of Supervisors in District 3.

District 4 is even less complicated.  Tom Berryhill has no vision, no ideas, and like Keating is running from political decisions made in the past. Berryhill and his ‘funneling money’ questions that he seems to be dodging every step of the way.  And Keating with her close ties to the paving paradise development community including selling her “opinions ” to the highest bidder.  Of the three running Frank Damrell  stands out compared to  the two tired political hacks he’s facing.

 

 

Why This MID Election is Important to You

Having gone to Modesto Irrigation District (MID) meetings regularly for more than ten years, researched their past, and following them with interest for more than twice that time, that there is no doubt that this election is crucial to MID’s and our future.

When you start to talk about MID people’s eyes have a tendency to glaze over after about 30 seconds, that is unless you are talking to them after they pay an electric bill during a hot spell when they have been using their air conditioning.   The fact is that MID was mismanaged for years by Tom Van Groningen (1993-2013) ,his cohorts on the Board and Allen Short, MID’s General Manager, during those same years.

A short look at MID’s history of business decisions shows an absence of, shall we say, critical thinking. It’s been suggested more than once if they’d flipped a coin instead of being led around by the nose or making the decisions themselves  they could have saved us about $500 Million dollars by the simple chance of the flip. From the geothermal fiasco, to a potential garbage burner to the overpriced (by 30 percent)  McHenry Ave solar farm contract north of town, it was one debacle after another.

Another fact is that a small group of business people led by Bill Lyons, yes the Bill Lyons of Mapes Ranch that wanted to sell our water to San Francisco, have controlled MID’s Board for this same period.  Bill has written checks for $5,000 to his special MID candidates (2 per election)  during contested election years. While his business partners, this year both developers and farmers,  took care of the third MID seat to the same fiscal level. His most recent beneficiaries were Paul Campbell and Jim Mortenson.  Campbell was elected and Mortenson was defeated by Jake Wenger four years ago.

So after they drove into almost $1 Billion dollars in debt what happened next?  Well first of all Larry Byrd, Nick Blom, followed by Jake Wenger two years later,  were elected to the MID Board.  Secondly the cost of natural gas plummeted.  This gave us the profit that people point to.  And what was the prudent course to take?  They started to pay down the debt.

Just as most of us learned as we matured you can’t live off of credit forever so the MID Board did the prudent thing.  It’s not sexy but it is necessary, you have to pay down the debt.  In the past MID, since they aren’t governed by the Public Utilities Commission, had the ability to our raise rates whenever they felt like it.

Our electric rates have been the same since 2011 so if you are feeling the effect of a high electric bill it means you used, like most of us,  a lot of electricity during the 31 days of 100 degree heat recently.

Now we’re faced with the decision of who to elect to the MID Board.  Both men are church going family men and business men.  But politically speaking that’s where the similarity ends. Stu has aligned himself with developers like Paul Zagaris, George Petrulakis, Mani Grewal, and special interest groups like Bill Lyons and company.  Jake has aligned himself with his friends, family, and the average working family.  Stu is a johnny come lately that admits to knowing little but what he’s read in the Bee, and has a penchant for making promises he can’t back up.  Jake has been fiscally responsible when it comes to being our voice on MID and is the most available person I’ve ever known in politics.  As an example if asked a question in person or online he’ll answer it immediately if time permits, and if it doesn’t or you have more questions he’ll give you his personal phone number and either give you the answer or get you the answer to your questions.  Unfortunately Stu isn’t knowledgeable about water or MID at all.  He’s like a one trick pony that looks nice but won’t take you anywhere.

The sound decision to make is to get up off you chair or couch and make sure you vote for Jake Wenger.

 

Modesto…Are You Paying Attention?

On August 8, 2017, the Modesto City Council will consider the 6/8/16 Healthy Economy Committee recommendation to maintain the current / 1995 general plan boundary.

Here is the pdf from the email we received GPA-10-001 CC Public Meeting Notice 8-8-17 SIGNED (1)  Being it’s difficult to find and without  the Committee’s specific (no maps or detailed references were provided) recommendations and any discussion it’s hard to know what to think.  I do remember when this conversation was going on during a Planning Commission meeting, we were blindsided by a massive expansionist effort propelled by  the Modesto Chamber of Commerce, led by Craig Lewis.  And on 8/2/17 they are going to give Mr. Lewis a high profile position on the Stan COG Measure L Citizens Oversight Committee.

But after the directions some on the Council and the Board of Supervisors have  been hinting at lately, you are forced to wonder if a potential  land grab, wholesale or piecemeal,  isn’t around the corner.

Transparency, Honesty, Do These Words Apply to Ted Brandvold and Modesto’s City Government?

Peeling the onion would be another way to describe what this series of stories is going to attempt to do. Like layers of an onion some will be longer and some shorter but hopefully they will provide insight to what is going on down at 1010 10th st.,  City Hall

 

At the end of January we heard Modesto Mayor Ted Brandvold express disappointment that  Wood Colony didn’t inform him they were setting up a MAC (Municipal Advisory Council). He made it sound like he was completely blindsided.  Could this have been true?

 

Possibly, but I sincerely doubt it.  You see I’m sitting here looking at an email from Cynthia Birdsill, City of Modesto-Community & Economic Development, dated September 26,2013 that says “FYI, the County has been meeting with Wood Colony to possibly create a MAC.”  This email was sent to City Manager Jim Holgersson and Brent Sinclair.

 

Now it’s within the realm of possibility that Ted wasn’t told by all three members of City staff…but…I’m looking at another email that’s from Land use attorney George Petrulakis three hours and thirty four minutes later  and he’s been reading the MAC proposal and is commenting to Cynthia Birdsill, Patrick Kelly, Steve Mitchel, and Brad Wall.

 

With all of those people  in the loop it would be doubtful that the Mayor would not be told by someone on City Staff.  But it gets better.  For those not following local politics when it comes to the Mayor, you get two for one.  First is George Petrulakis, the Ventriloquist and Ted Brandvold is the puppet on his lap.  George’s hands up Ted’s backside move and Ted’s mouth opens and closes.  George knowing about the MAC proposal makes it a foregone conclusion that Ted knows all about it.

 

So why was our Mayor being so disingenuous?   It’s all about public perception. Ted plays the affable elderly gent quite well.  And George wants to lull Wood Colony with a false sense of security.

 

And don’t worry there’s much more to come.

 

Are Modestans prepared for the flashbacks to the late 80’s and early 90’s?

Mayor Ted Brandvold and those who funded his campaign in the developer community are ready to place their grand plan for expansion in motion. They’ve already announced their intentions to lower building impact fees to developers which won’t lower prices to consumers but will pad the pockets of developers. Then in their minds the next logical step is to try to steal land that Wood Colony and Salida have been trying to protect.  Developers have been placed on the Alliance Board of Directors and the Modesto City Council to assure us this is the best course, but since these same developers own properties in these areas, Bill Lyons and Modesto Councilman Mani Grewal in Wood Colony and Dr.Stephen Endsley in Salida, how can we expect them to do anything other than to provide support to their own cause.

Obviously they can’t be trusted but who will stop them?  The money behind Brandvold’s election campaign owns and or controls property outside of Modesto so infill is just given lip service.  Endsley, who when heard of last was intent on building a garbage burner on Modesto’s south side,  has been itching to develop his property north of Kiernan inside the Salida plan.  And Mani Grewal and Bill Lyons own property in the Dakota triangle and so Brandvold and his supporters want to ignore the many people that spoke to the Modesto Planning Commission and go back to the good old days where developers rule. just like they did during the Village 1 debacle.  It will be no surprise to see City Staff finding reasons to support the developers cause because, after all, they want to keep their jobs.

Expect the same people that wanted to sell our water to San Francisco like the Chamber’s Janice Keating and Chamber lobbyist Cecil Russell, to tell the public how this will save Modesto and bring quality jobs. Except Lyons wants to build retail, which provides minimum wage jobs, Cecil waxes almost poetically about warehouse jobs in the Chamber’s monthly magazine and Endsley just craves action. After the good doctor received his check from MID’s ratepayers for $1.2 Million for not building his garbage burner, he’s been after Salida’s zoned business park which curiously enough surrounds Gregori High School.  We’ve even documented where Union Bank is fronting for Ryan Swehla and Benchmark in the sale of property north of Kiernan.

Recognize any of these names? Craig Lewis, Brad Hawn, Chris Murphy, George Petrulakis, Tom Nielsen, Ron Jackson, Dennis Wilson, Chris Esther, Kole Seifkin, Ron Ehrke, Mark Buckley, Warren Kirk, Steve Madison, Jim Mortensen, Jeff Burda, Randy Clark, Linda Sadler, Becky Meredith, Bill Zoslocki, Joan Clendenin, Steve Rank. They’re all members of the Chamber land use and Transportation Committee.  Expect to see any and all of these people coming out in the near future in favor of not only reverting back to old land use plans but for a massive,  expansive,  land grab.  Many of these same people already spoke in front of the Planning Commission in favor of extending Modesto’s sphere of influence all the way to the river to our West and North.  Nothing like building homes on some of the worlds richest and best soil for farming.

Developers even managed to place Brad Hawn on LAFCO so don’t expect organizations that are supposed to protect against SPRAWL to protect us from the developer’s greed.  The voters, understandably,  were frustrated by former Mayor Marsh’s policies but as we’ve already warned, we’ve jumped out of the frying pan and into the fire.  Mayor Marsh and those who supported him are responsible for lighting the fuse and will now act surprised that the developers’s power keg of GREED and SPRAWL goes off.

And what will the rest of Modesto’s City Council do?  Our guess is hey’ll admire the Emperor’s new clothes.

The Chamber Thumbs Its Nose at the Fair Political Practices Commission Rules and the Public

They say the truth is stranger than fiction and that has never been more obvious than in this election cycle.  The Modesto Chamber of Commerce, or at least three of their members,  have been pulling out all stops in an attempt to steal Measure I from the public.  Their two campaign flyers are filled with falsehoods, innuendos,, and blatant lies (that’s as kind as I can be at this point) and now their obfuscating the source of their money.

It’s bad enough they don’t list the FPPC number on either of their flyers.  And yes it is required but they have also managed through a series of ‘mishaps’ to make it almost impossible to follow the money.

Where Did the Documentation Go?

So we contacted the County Clerk’s office to try to follow the money trail.  Here is the official version: The Modesto Chamber of Commerce faxed to the County Clerk’s office their 497’s which is the document required when a contribution of $1,000 or more is received and it is supposed to be filed within 24 hours of receipt..  But since this is a city Measure it is supposed to go to the City Clerk’s office.  ‘Unfortunately’ it was misfiled in the manila folder (no matter how many times people and the BoS have requested, the County Clerk’s office refuses to place these documents on line) of another Political Action Committee or PAC  account of the Chambers.  This is extremely strange considering 497 documents weren’t supposed to be accepted at the County Clerk’s office period.

For another unknown reason a clerk was rummaging through the outdated PAC file and discovered the document (how lucky for us was that?).  It was then forwarded to the City Clerk’s office 11 days late.

Some interesting Coincidences

There is a history between someone who now works at the County Clerk’s office in the election division with access to campaign statements and the Chamber of Commerce.  The Chamber and the Bee’s former opinion page editor, who for the last 10 years supported three candidates to the Modesto Irrigation Board, all of whom were sponsored by Bill Lyons (who wanted to sell the free water he gets from his special arrangement with MID).  The cabal of three at MID that was in place three years ago, Tom VanGronigan, Glen Wild and Paul Warda, who were supported by the Bee and the Chamber during their election campaigns) were pushing to sell our water to San Francisco.  The Bee, Chamber, and Bill Lyons  supported the sale which after much intense public discussion was turned down despite the Bee’s endorsement.

Now we see the most current aligning of stars with Bill Lyons pushing against Measure I (he has property in the Beckwith Dakota Triangle –  read Wood Colony, that he wants to develop) along with the Modesto Chamber of Commerce and (at this writing the Bee hasn’t made a public comment) with a friend possibly in position to obfuscate the public knowledge of the money trail.

While we will say without any qualms and with many thanks from us that County Clerk Lee Lundrigan looked into events and has been most helpful in explaining the much traveled documentation: an unknown someone in her office ‘accidentally’ accepted wrongly submitted faxes and misfiled these important documents and then someone in her office fortunately discovered the mistake nine days later and then forwarded the documentation the the City Clerks office where it was placed online for the public on Monday afternoon.

Another  Coincidence

When checking for updates on the Campaign documents, yesterday, Oct. 22nd was a mandatory reporting day, the former online  497’s were missing.  According to the city Clerk’s office the missing documents along with any updates will be online by day’s end.

Why does this matter?

There are several reasons, actually violating FPPC campaign laws would be one.  But during an election season opponents and the public have a right to know how much money is involved and where it’s coming from.  Since the Chamber and their three donor amigos and their friends like George Petrulakis are very familiar with election laws and rules it’s our opinion this has been willful and orchestrated.

Bruce “Dark Side” Frohman, Methinks Thou Doth Protest Too Much

Okay I know the title is a misquote of a line from Shakespeare that has entered the common  vernacular but seldom has it been more appropriate.  Public Record Requests (PRR) are a valuable tool in trying to peek behind the curtain  of deceit that sometimes appears when dealing with public entities and  public figures.  We use it here on the Eye on a regular basis, as do others .  In this instance a  PRR was made in an attempt to discover any ongoing correspondence between Modesto’s Mayor, Council, and Staff.

                                              Some Context 

Much to my surprise  an exchange of ‘curious’ emails between  Modesto’s Mayor Marsh and former one term  Modesto City Council Bruce “Dark Side” Frohman were among the several hundred that were turned over.  It’s common knowledge,  at one time prior to being elected Mayor,  Marsh was an advocate for the preservation of prime farmland.  Soon after the election it was revealed he (Marsh) not only attended the private Modesto  Chamber of Commerce Transportation Committee meetings but publicly stood quietly on the sidelines while the Modesto Chamber and its members plotted to extend Modesto’s General Plan boundaries West and North to the river.  What was unknown  to the public at this time Marsh was a co-conspirator with his own plan.

In the past Dark Side had  been publicly siding with Denny Jackman and others for the preservation of prime farmland while pushing development onto less productive soils..but something changed recently.  After the Council withheld it’s previously promised support for a watered down version of RUL last spring and refused to place it on the ballot Denny was forced to seek signatures for his Stamp Out Sprawl initiative.

Mayor Marsh had been throwing the Board of Supervisors (BoS) under the bus at every opportunity.  He actually started using them as the boogie man and the reason for his land grab.  To “protect the farmers” he claimed.  And of course it came at a price, over 1,000 acres of prime farmland and the ability to place retail businesses inside the Beckwith Dakota Triangle.  This is akin to starting a small fire in a tinderbox forest and not expecting the Rim Fire which we experienced last year to develop. The Rim Fire eliminated hundreds of thousands of acres of forest and Marsh’s big-box retail would eventually eliminate the family farms in and around Wood Colony.  But he doesn’t care.

So when I wrote three sentences to my private facebook friends I didn’t expect the hoopla that ensued. Here is what I wrote.

“Stamp Out Sprawl has new opposition. Bruce Frohman has gone over to the dark side and has contacted Modesto Mayor Garrad Marsh to co-author the con or opposition to SOS on the ballot. More to come. Watch EyeOnModesto.com for more information including the damning emails to be released soon.” 

These sentences spawned five articles from both Dark Side and the sites owner.  Each one funnier  than the prior one from my perspective since they flail out at anyone who commented  either on the sites’s stories or on my facebook follow-up.

Dark Side made the usual protestations, the statements were taken out of context, that his privacy was violated and I should have asked for permission, that Marsh’s emails were being monitored and  maybe my favorite was that it was  Orwellian. My response was: Your email wasn’t between private citizens, it was sent to the Mayor of Modesto at his ‘official’ city email so there was no expectation of privacy. It was obtained by a public record request which focused on developers in the Salida area, so asking for permission to publish it would seem to be a moot point.

Instead of me listing some of the phrases he used, here are Dark Side’s own words:    “Regarding Mr. Drake’s comment, I have no expectation of privacy when I write an email. However, I was quite surprised that the Mayor of Modesto’s email is being monitored so that those who may disagree with Mr. Drake’s viewpoint can be attacked without opportunity to respond. To have emails monitored in such a fashion seems Orwellian. Characterizing me, a private citizen, as having gone to the dark side for wanting to participate in the discussion is insulting and unreasonable. It is regrettable that some folks cannot engage in a discussion without name calling and personal attacks.”

Now compare my three sentences to what Dark Side wrote.  Kind of funny isn’t it?

After using over six hundred words in response to my three sentences, the one thing he didn’t supply is the email exchange:  From Frohman to Marshl: Subject: Denny Jackman Urban Limit Line Initiative  Bruce ‘Dark Side‘ Frohman’s exact words to the mayor on August 27, 2014 were: I would like my name to appear on the ballot argument opposing the initiative.  “Would you consider co-authoring a ballot argument, including me as a signatory?”

Is ambiguity involved?  Could there be a misunderstanding?  Is he undecided?  Were his words twisted out of context?  At least now you know why he was blustering and making all kinds of claims and  accusations.

Its almost understandable that the Mayor put further contact off for several months.  The purpose here isn’t to demonize anyone but with so many futures at stake in Wood Colony,  Salida, and Modesto knowing who REALLY supports you and who is drilling a hole in the bottom of your life boat IS important.

On July 26th Modesto City Councilman John Gunderson wrote an article under Community Columns John Gunderson: Clear thinking needed on Salida annexation issue where he makes several dubious and completely wrong claims.  Now we can’t tell you if just can’t comprehend what he reads or is just being malicious.  What we can say is when he relayed his columns to fellow council members, staff and others (yes the result of a public record request) where he claims to have done the research himself. Well folks, Modesto City Councilman John Gunderson is at it again. I must really crawl under that guy’s skin because he can’t seem to go a week without a Facebook post on Salida. This week, he regurgitated an e-mail I wrote to the council in June regarding a tip I received from a Salidan that Modesto had hired a consultant to help them annex Salida.

While both Mayor Marsh and city planner, Patrick Kelly replied that the city didn’t hire Keith Bergthold as an annexation consultant, there’s something still amiss here. Why would Bergthold tell his Fresnan friend that he had an eighteen month contract otherwise? Perhaps it was just being bandied about and was all verbal at that point? Either way, its DOA now because the city can’t very well go and hire him after denying that they hadn’t. And how effective would he be with any kind of collaboration building with Salida? (Yes, that’s a rhetorical question.)

 
Councilman Gunderson can’t help but crank up the old propaganda machine starting right in the second sentence with, “Think the Goodwin Study would have been enough, the annexation concept was proven to be a bad idea.” First of all, anyone want to wager that Councilman Gunderson has NOT read nor thoroughly examined the Goodwin Study? Because if he had, he would know it shows that Modesto would stand to rake in $22.8 million a year in revenue in annexing Salida at full build out of the Salida Community Plan. How does that prove the annexation concept is a bad idea? And if it were proven to be a bad idea, then why is Modesto keeping Salida in their general plan? Councilman Gunderson wrote in his community column just two weeks ago that, “…the majority of the Modesto City Council feels (annexation) is still a possibility“. And he says I have “nothing to worry about???”

And once again, the councilman nay says Salida incorporating, “Should stop worrying about incorporation for Salida as well because that can’t happen either.” I previously responded to his comment about whether or not Salida can be incorporated, but it apparently didn’t register in his brain so I’ll say it again, “Keep in mind that no one has ever applied to incorporate Salida as a city. If no one has ever tried, how does anyone know whether or not it can be done?

What he also doesn’t seem to comprehend is only supplying water in exchange for land -IS- extortion when you supply water to other areas without forcing them to turn over their land! To put it into language he’ll understand, its known as an “out-of-boundary service agreement” and the council approves them all the time. And once again, I’m going to call him out on his double standard for trying to justify water extortion by saying “Modesto ratepayers deserve better” when Beard Industrial’s sweetheart deal costs ratepayers and the city millions upon millions each year. The city of Modesto supplies both water AND sewer to Beard without annexing the land. (Read more about Beard)
 
Lastly, Councilman Gunderson said, “Modesto’s water should be leveraged for the best possible outcome that helps pay for services for residents of Modesto proper, not the surrounds.” When the City of Modesto purchased the Del Este Water Company in the mid-1990’s, they took over the existing wells and infrastructure in Waterford, Grayson, Del Rio, part of Turlock and Salida. So technically, they bought Salida’s (et al) water so its not “Modesto’s water” he wants to “leverage” to begin with. Our water comes primarily from wells in Salida so he wants to leverage our own water against us! Additionally, development occurs in all of those other former Del Este served communities and yet, Modesto does not “leverage” the water by extorting land from them; except in Salida.

In case you were wondering why Councilman Gunderson is so fixated on Salida its because if Salida were annexed, we would be assimilated into his district. That’s right, we would be the constituents of a man who feels water extortion upon us is justified because the majority Modesto residents in his district “deserve better” than the Salidans.

More fun from “Cat”. Think the Goodwin Study would have been enough, the annexation concept was proven to be a bad idea. Catherine has nothing to worry about on that. Should stop worrying about incorporation for Salida as well because that can’t happen either. Refusing City of Modesto water for new development within the Salida TPA… refusal is extortion? Modesto ratepayers deserve better than that. Modesto’s water should be leveraged for the best possible outcome that helps pay for services for residents of Modesto proper, not the surrounds. Development outside of a city’s limits is a losing proposition because of the State’s mandated property tax distribution scheme.

To the Modesto City Council:
I received the following from a Salidan today, “My father lives in Fresno and is friends with a man named Keith Bergthold. Keith told my dad he was hired by the city of Modesto to see what can be done about annexing Salida.”
I’ve met Mr. Bergthold at the Carpenter’s Church General Plan presentation in May and I also attended the April Stanislaus Community Foundation breakfast that was connected with Fresno Metro Ministries.
So you can fire Mr. Bergthold because HELL WILL FREEZE OVER before you ANNEX SALIDA or the Kiernan Corridor! Get that through your thick skulls!! How many different ways and from different people do you need to hear that before it sinks in?!? It doesn’t appear that turning out hundreds of people to voice that works since both Salida and Wood Colony have done that!!
I’ve told you once if I’ve told you a thousand times, we are willing to work with you if you want to develop the Kiernan Corridor (although I don’t know why since you are so IMPOSSIBLE, OBSTINATE and DYSFUNCTIONAL about our communities) BUT YOU’RE NOT GOING TO JUST TAKE SALIDA NO MATTER WHOM YOU HIRE!!! Your status quo land grab days are over!!! Get a clue!!!
Since you have a contract with Mr. Bergthold, why don’t you have him use his remaining time in educating you about “build up, not out”. Fresno has done well with that. Look around their Kaiser Hospital and then look around Modesto’s. And in the meantime, LEAVE SALIDA and WOOD COLONY ALONE you greed-driven sellouts!!!

WHO hired him then? I was told he has an 18-month contract. Emerson has filed a public information request with the city. Even if it turns out that you’re right and the city has nothing to do with it, then you need to find out who working to annex Salida on your behalf.
